NEXTSPARES DISTANCE SALES AGREEMENT
1. PARTIES
This Distance Sales Agreement ("Agreement") is entered into electronically between the Seller and Buyer for transactions facilitated through the NextSpares marketplace ("Platform"), operated by ION Controls Otomasyon ve Kontrol San. Tic. Ltd. Şti. ("NextSpares").
2. SUBJECT
The Agreement governs the sale of spare parts and related products listed on the Platform under the terms presented at checkout and in the order confirmation.
3. PRODUCT AND PRICE INFORMATION
Product details, quantity, unit price, taxes, shipping, and total payable amount are shown before order confirmation. The Seller is responsible for accurate listing information.
4. ORDER AND PAYMENT
The Buyer submits an order through the Platform. Payment is processed using available payment methods. The order becomes binding when accepted according to Platform workflow and Seller confirmation rules.
5. DELIVERY
Delivery terms, lead times, and shipping responsibility are defined in the order and applicable delivery policy. Risk of loss may pass upon delivery or collection depending on the agreed Incoterm or delivery method.
6. RIGHT OF WITHDRAWAL
Where applicable law grants a right of withdrawal, the Buyer may exercise that right within the statutory period subject to exceptions for customized or perishable goods and B2B transactions where withdrawal rights do not apply.
7. DEFECTIVE GOODS
The Buyer must notify defects within applicable legal periods. Remedies may include repair, replacement, price reduction, or cancellation under applicable law and Seller policy.
8. COMPLAINTS
Complaints may be submitted through Platform support or info@nextspares.com.
9. GOVERNING LAW
This Agreement is subject to applicable Turkish commercial and consumer protection law unless mandatory rules provide otherwise.
